Terms of Use

1. Agreement to Terms

By accessing fieldlinewa.com ("the Site"), purchasing a product, or subscribing to our services, you agree to these Terms of Use. If you do not agree, please do not use the Site. These Terms form a binding agreement between you and Pacific Build Compliance, operating under the Fieldline WA brand ("we," "us," or "our").

2. Who May Purchase

Our products are sold to businesses for business use. By purchasing, you represent that:

• You are at least 18 years old.
• You have authority to enter this agreement on behalf of your business.
• Your business is a bona fide Washington construction contractor or a business that will use the documents for Washington construction compliance.

3. The Products

What we sell

We sell template compliance documents (written safety programs, employee handbooks, contracts, policy kits, and similar) specifically built for Washington construction contractors. Documents are delivered as DOCX, PDF, or both, either directly or through a customization workflow.

Customization

Many products include an AI-assisted customization step where your business information (company name, address, contractor registration, trade, crew size) is substituted into the template. Customized documents are prepared specifically for the purchasing entity.

License

Upon payment, we grant you a single-entity, non-transferable, non-exclusive license to use the purchased document(s) within the business that purchased them. You may:

• Print, distribute, and use the documents internally within your business.
• Provide documents to your employees, subcontractors, and required regulators.
• Store copies in your business records.

You may not:

• Resell, sublicense, redistribute, or share the documents outside your business.
• Remove copyright notices or attribution.
• Use the documents to train AI models or build competing products.
• Use the documents for any business other than the purchasing entity.

5. Payment

Prices are listed in U.S. dollars on the Site. You agree to pay the listed price plus any applicable taxes. Payment is typically processed via email invoice through a third-party payment processor. Payment must be received before we deliver customized documents.

6. Delivery

We deliver purchased products via email to the address you provide at order. Standard delivery is within 2 business days of payment. Customized products may take longer depending on complexity. If there is a delay, we will notify you.

7. Subscriptions

If you purchase a monthly subscription:

• Your first 14 days may be free (if the free trial offer is active when you enroll).
• Your subscription renews monthly at the then-current rate until you cancel.
• You may cancel at any time by emailing orders@pacificbuildcompliance.com. Cancellation stops future charges; it does not entitle you to a refund for the current billing period.
• Subscription benefits (including law-change updates) end when your subscription ends.
• We may change subscription pricing with at least 30 days' notice. Your renewal at the new price constitutes acceptance.

8. Updates

Washington law changes frequently. We update our products when L&I, the Employment Security Department (ESD), or the legislature makes a change that materially affects a product. Subscribers receive updates automatically. One-time purchasers receive updates for 12 months from the date of purchase.

9. Refund Policy

Our refund policy is set forth in our Refund Policy, which is incorporated into these Terms.

10. Intellectual Property

All content on the Site — including text, graphics, logos, product templates, and software — is owned by Pacific Build Compliance or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. Your license under Section 3 is the only right you receive. All other rights are reserved.

11. Your Conduct on the Site

You agree not to:

• Use the Site in any way that violates any applicable law.
• Attempt to gain unauthorized access to any part of the Site or our systems.
• Use automated tools to scrape, copy, or harvest content.
• Impersonate another person or business.
• Introduce viruses, malware, or other harmful code.

12. Limitation of Liability

To the maximum extent permitted by Washington law, in no event will Fieldline WA, Pacific Build Compliance, or our affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products — including lost profits, lost revenue, lost data, or business interruption — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to your use of the Site or our products will not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain damages, so some of these exclusions may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Fieldline WA, Pacific Build Compliance, and our affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or our products in violation of these Terms or applicable law.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to choice-of-law principles. Any dispute arising out of or relating to these Terms or our products will be resolved as follows:

1. Meet and confer: The parties will first attempt to resolve the dispute informally for 30 days.
2. Mediation: If unresolved, the parties will attempt mediation in King County, Washington.
3. Binding arbitration or court: If mediation fails, disputes will be resolved by binding arbitration in King County, Washington under the AAA Commercial Arbitration Rules, unless either party elects to proceed in small claims court (where available).

You waive any right to participate in class actions or representative proceedings against us.

15. Changes to These Terms

We may update these Terms when our business or the law changes. The "Effective" date at the top of this page shows when it was last revised. Continued use of the Site after changes constitutes acceptance.
